Additional Terms and Conditions for BPP Pass Assurance Scheme

These Additional Terms and Conditions apply to all Applicable Courses which offer the BPP Pass Assurance Scheme.

These Additional Terms and Conditions are in addition to the General Terms and Conditions and the Website Terms of Use (if you purchase the Applicable Course via the Website) that apply to the sale of any Classroom Course or Online Course.

These Additional Terms and Conditions do not apply to programmes provided by BPP University College of Professional Studies Limited and therefore do not apply to full-time ACCA courses and any examinations relating to full-time ACCA courses.

Please read these Additional Terms and Conditions carefully before purchasing an Applicable Course which offers the BPP Pass Assurance Scheme. Please print off or keep a copy of these Additional Terms and Conditions for your records.

BPP will not file or otherwise keep a copy of the agreement concluded between you and BPP and a concluded agreement will not be available from BPP at a future time and date.

By ordering an Applicable Course to which the BPP Pass Assurance Scheme applies, you are confirming your agreement to be bound by these Additional Terms and Conditions.

If there is any conflict between these Additional Terms and Conditions, the General Terms and Conditions and the Website Terms of Use, the conflict shall be resolved according to the following order of priority:

(1) the Additional Terms and Conditions

(2) the General Terms and Conditions; and

(3) the Website Terms of Use.

Clauses 1 and 2 apply to all Applicable Courses under the BPP Pass Assurance Scheme. Clause 3, 4 or 5 will apply depending on the relevant Applicable Course you purchase.

1. Definitions

1.1. Words and expressions defined in the General Terms and Conditions have the same meaning in these Additional Terms and Conditions except to the extent that they are varied by these Additional Terms and Conditions.

1.2. In these Additional Terms and Conditions, the following terms have the following meanings:

  • “Applicable Courses” means part-time Classroom Courses and Online Courses for the qualifications and papers set out in Clauses 3.2, 4.2 and 5.1 of the Additional Terms and Conditions, provided by BPP in preparation for the Exams and Exams on Demand and which offer the BPP Pass Assurance Scheme;
  • “Awarding Body” means:  (a) in relation to FIA and part-time ACCA, the Association of Chartered Certified Accountants; (b) in relation to CIMA, the Chartered Institute of Management Accountants; and (c) in relation to AAT, the Association of Accounting Technicians;
  • “BPP Learning Media Case Toolkit” means the package of materials specifically written by BPP Learning Media Limited for students who are enrolled and registered on a CIMA T4 Applicable Course;
  • “BPP Pass Assurance Scheme” means the pass assurance scheme offered by BPP in relation to the Applicable Courses pursuant to these Additional Terms and Conditions; “BPP Study Centre” means any study centre operated by BPP in the United Kingdom;
  • “CBA” means an Exam which is sat as a computer based assessment and includes computer based assessments set by CIMA, computer based exams set by ACCA and computer based tests set by AAT;
  • “Course Tests” means the tests set by BPP during and in relation to an Applicable Course and includes course tests set by BPP for ACCA, FIA and CIMA Applicable Courses and knowledge tests set by BPP for AAT Applicable Courses;
  • “Exam” means any examination paper relating to the Applicable Courses set out in Clauses 4.1 and 5.1 (as applicable) and which are set by the relevant Awarding Body and sat at a BPP Study Centre or at an Awarding Body’s centre;
  • “Exams on Demand” means a CBA relating to the Applicable Courses set out in Clause 3.1 which can be sat at a participating BPP Study Centre on demand, rather than on specific dates set by the relevant Awarding Body;
  • “Final Mock Exam” means the final online mock examination set by BPP in relation to the Applicable Course;
  • “Offer Period” means the period from 1 January 2012 until the BPP Pass Assurance Scheme is withdrawn by BPP;
  • “Official Course Completion Date” means: (a) in relation to Applicable Courses that are taught as Classroom Courses, the date on which official tuition relating to that Classroom Course is completed; (b) in relation to Applicable Courses that are taken as Online Courses, the date that is 7 days after the commencement of the final stage of that Online Course;
  • “Online Classroom Course” an Asynchronous Online Course which does not have a predetermined start date and is available for study by you immediately following delivery by BPP;
  • “Online Classroom Live Course” means a Synchronous Online Course which is only available for access by you on a predetermined start date;
  • “Qualifying Student” means any student who has purchased and participates in an Applicable Course at any BPP Study Centre or online with BPP within the Offer Period and qualifies for the BPP Pass Assurance Scheme pursuant to these Additional Terms and Conditions;
  • “Re-sit Course” means any of the re-sit courses set out in Clause 4.4 that is sat by a Qualifying Student at a BPP Study Centre or online with BPP due to that Qualifying Student having previously attended an Applicable Course, but having not passed the Exam relevant to that Applicable Course;
  • “Re-sit Exam on Demand” means an Exam that is re-sat by a Qualifying Student at a BPP Study Centre due to that Qualifying Student having previously sat, but not having passed, the Exam relating to the Applicable Course; and
  • “Revision Course” means a revision course provided by BPP in relation to an Applicable Course and its relevant Exam and taught as a Classroom Course or an Online Classroom Live Course.

2. Additional Terms and Conditions for all Applicable Courses under the BPP Pass Assurance Scheme

2.1. In order to be a Qualifying Student under the BPP Pass Assurance Scheme, you must meet all of the following requirements in addition to any specific requirements relating to your relevant Applicable Course set out in Clauses 3 to 5 of these Additional Terms and Conditions:

  • 2.1.1. complete the relevant Applicable Course with BPP, either as a Classroom Course or an Online Course; and
  • 2.1.2. have not passed the Exam in relation to your Applicable Course on your first attempt; and
  • 2.1.3. have paid your Course Fees in full by the date upon which those Course Fees were due to be paid under the General Terms and Condition for the Applicable Course; and
  • 2.1.4. notify BPP customer services at the time of booking your Re-Sit Exam on Demand or Re-Sit Course that you wish to use the BPP Pass Assurance Scheme.

2.2. The BPP Pass Assurance Scheme shall not apply where the requirements of Clause 2.1, and clauses 3, 4 or 5 (as applicable) above have not been met in full.

2.3. The BPP Pass Assurance Scheme and places on Exams, Re-sit Exams on Demand and Re-sit Courses at BPP Study Centres are subject to availability. Re-sit Exams on Demand must be taken online with BPP and Re-sit Courses must be taken at the same BPP Study Centre that the original Applicable Course was taken.

You may be offered an alternate venue if the BPP Study Centre where your original Applicable Course was taken is unavailable on the date requested for an Exam or Re-sit Exam on Demand or Re-sit Course. You may be offered an alternate Re-sit Course where your first choice of Re-Sit Course is unavailable on the date requested. If you decline any such an offer, BPP shall be under no obligation to provide any Re-sit Course to you under the BPP Pass Assurance Scheme.

2.4. Only one Re-sit Course (where applicable) will be offered to each Qualifying Student in respect of each Applicable Course purchased. If any Qualifying Student does not pass the relevant Exam following a Re-sit Course, BPP shall not be obliged to offer that Qualifying Student any further Re-sit Course(s). This Clause does not prevent a Qualifying Student from booking and enrolling on any further Classroom Course, Online Course or Re-sit Course at their own cost.

2.5. Where Re-sit Exams on Demand and/or Re-sit Courses are provided to Qualifying Students in accordance with the BPP Pass Assurance Scheme under these Additional Terms and Conditions, the relevant free Re-sit Exam on Demand or Re-sit Course shall not include any Study Materials. You will be responsible for ensuring that you acquire, at your own cost, any additional Study Materials which you require for the relevant Re-sit Exam on Demand or Re-sit Course.

2.6. BPP shall only be obliged to provide Re-sit Exams on Demand and Re-sit Courses (as applicable) to Qualifying Students pursuant to these Additional Terms and Conditions. For the avoidance of doubt, unless specifically stated, the BPP Pass Assurance Scheme does not include any additional tuition or revision courses that do not form part of the Re-sit Exams on Demand or Re-sit Courses (as applicable).

2.7. The BPP Pass Assurance Scheme doe not include any other discount or financial benefit to Qualifying Students and excludes any amounts payable to Awarding Bodies or any other professional body for membership.

2.8. BPP may withdraw the BPP Pass Assurance Scheme at any time in its sole discretion. Any such withdrawal shall not affect students who have purchased and are participating in an Applicable Courses at the date of such withdrawal. Such students shall continue to be eligible for the BPP Pass Assurance Scheme in relation to the Applicable Course which they are undertaking.

2.9. Qualifying Students may not transfer or assign the Re-sit Exam(s) on Demand and/or Re-sit Course(s) (as applicable) for which they are eligible under the BPP Pass Assurance Scheme to any other person.

2.10. In no circumstances shall BPP either: (i) refund your Course Fees nor (ii) provide a cash alternative to the BPP Pass Assurance Scheme, in the event that any Re-sit Exams on Demand or Re-sit Courses are unavailable pursuant to clause 2.3.

2.11. If you have breached, or, are in breach of any of the General Terms and Conditions you will not be eligible for the BPP Pass Assurance Scheme.

2.12. BPP may update or amend these Additional Terms and Conditions from time to time to comply with law or to meet its changing business requirements without notice to you. Any updates or amendments will be posted on the Website.

2.13. These Additional Terms and Conditions and any other matters arising out of or in relation to these Additional Terms and Conditions, shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the English courts to settle any dispute which may arise out of or in connection with these terms and conditions.

3. Additional Terms and Conditions for ACCA FIA, CIMA Certificate, AAT and part-time ACCA Knowledge Exams on Demand

3.1. Subject to the provisions of Clause 2 and this Clause 3, if you are a Qualifying Student who has purchased one of the Applicable Courses relating to the Exams set out in Clause

3.2 below, and you do not pass the Exam on Demand in relation to your Applicable Course on your first attempt, you shall be permitted to sit a maximum of two CBA Re-sit Exams on Demand relating to the Applicable Course, free of charge at a BPP Study Centre. Any further Re-sit Exams on Demand required shall be at your own expense. 3.2. For the purposes of this Clause 3, Applicable Courses relate to the following Exams to which the BPP Pass Assurance Scheme applies:

  • 3.2.1. part-time ACCA: F1, F2 and F3;
  • 3.2.2. ACCA FIA: FAB, FMA and FFA;
  • 3.2.3. CIMA: C01, C02, C03, C04 and C05;
  • 3.2.4. AAT: BAI, BAII, BCCG, PEAF, API, APII, CMGT, CRS, FNST, BGT, FMPF, PTX, BTX, CRMC, ITX and EXA.

3.3. In addition to the requirements set out in Clause 2.1 above, you must:

  • 3.3.1. sit the Exam on Demand and Re-sit Exam on Demand relating to your Applicable Course at a BPP Study Centre; and
  • 3.3.2. book and sit your first Exam on Demand for your Applicable Course at a BPP Study Centre within three (3) weeks of the Official Course Completion Date; and
  • 3.3.3. you must complete all Re-sit Exam(s) on Demand for your Applicable Course at a BPP Study Centre within eight (8) weeks of the Official Course Completion Date; and
  • 3.3.4. for FIA, CIMA and part-time ACCA Applicable Courses: record scores of 75% or more on every Course Test and 50% or more on the Final Mock Exam (the Course Tests and Final Mock Exam may be taken multiple times during your Applicable Course until your reach your desired score, but may not be taken after the Official Course Completion Date); or
  • 3.3.5. for AAT Applicable Courses: record scores of 80% or more on every Course Test and in the Final Mock Exam (the Course Tests and Final Mock Exam may be taken multiple times during the term of the Course until a you reach your desired score, but may not be taken after the Official Course Completion Date).

4. Additional Terms and Conditions for Professional Level CIMA and part-time ACCA

4.1. Subject to the provisions of Clause 2 and this Clause 4:

  • 4.1.1. if you are a Qualifying Student who has purchased one of the Applicable Courses relating to any of the Exams set out in Clause 4.2 below and the accompanying Revision Course, and you do not pass the Exam in relation to your Applicable Course on your first attempt, you will be permitted to book and enrol on one of the Re-sit Courses set out in Clause 4.4.1 to 4.4.3 below relating to the same Exam, at that Re-sit Course’s next sitting, free of charge; or
  • 4.1.2. if you are a Qualifying Student who has purchased a CIMA Gateway Applicable Course and you do not pass the Exam in relation to your Applicable Course on your first attempt, you will be permitted to book and enrol on one of the Re-sit Courses set out in Clause 4.4.4 only relating to the same Exam, at that Re-sit Course’s next sitting, free of charge;
  • 4.1.3. if you are a Qualifying Student who has purchased one of the Applicable Courses set out in Clause 4.2 below as an Online Course and you have not purchased the accompanying Revision Course, and you do not pass the Exam in relation to your Applicable Course on your first attempt, you will be permitted to book and enrol on one of the Re-sit Courses set out in Clause
  • 4.4.4 only relating to the same Exam, at that Re-sit Course’s next sitting, free of charge;

4.2. For the purposes of this Clause 4, Applicable Courses relate to the following Exams to which the BPP Pass Assurance Scheme applies:

  • 4.2.1. ACCA Skills: F4, F5, F6, F7, F8 and F9;
  • 4.2.2. ACCA Essentials: P1, P2 and P3;
  • 4.2.3. ACCA Options: P4, P5, P6 and P7;
  • 4.2.4. CIMA Operational: E1, P1 and F1;
  • 4.2.5. CIMA Management: E2, P2 and F2;
  • 4.2.6. CIMA Strategic: E3, P3 and F3;
  • 4.2.7. CIMA Gateway

The Applicable Courses set out above can be purchased as either Classroom Courses or Online Courses. Revision Courses (if applicable) must be purchased as a Classroom Course or an Online Classroom Live Course. Applicable Courses and Revision Courses do not need to be taken in the same mode for the BPP Pass Assurance Scheme to apply.

4.3. In addition to the requirements set out in Clause 2.1 above, you must:

  • 4.3.1. submit both Course Tests by the dates specified by your tutor on the Applicable Course and achieve a minimum score of 30% on each of those Course Tests; and
  • 4.3.2. for Classroom Courses and Online Classroom Live Courses, have a full attendance record for your Applicable Course and the relevant Revision Course (if applicable); and
  • 4.3.3. complete both your Applicable Course and your Revision Course (if applicable) prior to attempting your Exam.

4.4. Subject to the provisions of Clause 2 and this Clause 4, Qualifying Students may choose any one of the following Re-Sit Courses relating to the same Exam to be taken at the next sitting:

  • 4.4.1. for all ACCA Exams: a Classroom Course; or an Online Classroom Course; or a Revision Course (excluding Online Classroom Live Courses); or a question day course;
  • 4.4.2. for all CIMA Applicable Courses: a Classroom Course; or an Online Classroom Course; or a Revision Course (excluding Online Classroom Live Courses);
  • 4.4.3. for CIMA Gateway only: an Online Course (excluding Online Classroom Live Courses);
  • 4.4.4. for purchases of an Online Course only and no Revision Course: an Online Course (excluding Online Classroom Live Courses).

4.5. If you are a Qualifying Student who has purchased a CIMA Applicable Course and you:

  • 4.5.1. do not pass the Exam in relation to your Applicable Course on your first attempt; and
  • 4.5.2. you have subsequently undertaken the CIMA online re-sit course or CIMA Strategic level computer-based question day, and subsequently do not pass the Exam on your second attempt you will be permitted to book and enrol on either a Revision Course or a computer-based question day course at the next available sitting. You will not be eligible for any other free Re-Sit Course pursuant to Clause 4.4 above.

4.6. Only one Re-sit Course (where applicable) will be offered to each Qualifying Student in respect of each Applicable Course purchased. If any Qualifying Student does not pass the relevant Exam following a Re-sit Course, BPP shall not be obliged to offer that Qualifying Student any further Re-sit Course(s). This Clause does not prevent a Qualifying Student from booking and enrolling on any further Classroom Course, Online Course or Re-sit Course at their own cost.

4.7. Re-sit Courses (where applicable) do not include the cost of any additional Exams relating to that Re-sit Course, which must be paid for by the Qualifying Student.

5. Additional Terms and Conditions for T4 Level CIMA Exams

5.1. Subject to the provisions of Clause 2 and this Clause 5, if you are a Qualifying Student who has purchased an Applicable Course relating to the CIMA T4 Exam module, and you do not pass the Exam in relation to the Applicable Course on your first attempt, you shall be permitted to book and enrol on one of the Re-sit Courses set out in Clause 5.3 below relating to the same Exam at that Re-sit Course’s next sitting free of charge.

5.2. In addition to the requirements set out in Clause 2.1 above, you must: 5.2.1. submit both Course Tests by the dates specified by your tutor on the Applicable Course and achieve a minimum score of 30% on each of those Course Tests; and 5.2.2. have a full attendance record for the Applicable Course.

5.3. Subject to the provisions of Clause 2 and this Clause 5, Qualifying Students may choose any one of the following Re-Sit Courses to be taken next sitting relating to the same Exam:

5.3.1. Qualifying Students who purchased a Classroom Course where their first Exam is in March and their re-sit Exam for the Applicable Course will be in May; or where their first Exam is in September and their re-sit Exam for the Applicable Course will be in November (and they are therefore using the same preseen material (as previously studied)):

5.3.1.1. days 4 and 5 of the Classroom Course; or

5.3.1.2. the full Online Course.

5.3.2. Qualifying Students who purchased a Classroom Course or Online Course where their first Exam is in May and their re-sit Exam for the Applicable Course is in September or where their first Exam is in November and their re-sit Exam for the Applicable Course is in March (and are therefore using a new preseen material (as not previously studied)):

5.3.2.1. days 1, 4 and 5 of the Classroom Course; or

5.3.2.2. the full Online Course (only available for Re-Sit Courses with a May or November exam date).

5.4. Qualifying Students will also be provided with a free BPP Learning Media Case Toolkit upon commencement of their Re-Sit Course.

5.5. Only one Re-sit Course (where applicable) will be offered to each Qualifying Student in respect of each Applicable Course purchased. If any Qualifying Student does not pass the relevant Exam following a Re-sit Course, BPP shall not be obliged to offer that Qualifying Student any further Re-sit Course(s). This Clause does not prevent a Qualifying Student from booking and enrolling on any further Classroom Course, Online Course or Re-sit Course at their own cost. 5.6. Re-sit Courses (where applicable) do not include the cost of any additional Exams relating to that Re-sit Course which must be paid for by the Qualifying Student.
