Additional Terms and Conditions for BPP Pass Assurance Scheme

These Additional Terms and Conditions apply to all Applicable Courses purchased on or after 1 January 2015 which offer the BPP Pass Assurance Scheme.

These Additional Terms and Conditions are in addition to the Terms and Conditions and the Website Terms of Use (if you purchase the Applicable Course via the Website) that apply to the sale of any Classroom Course or Online Course.

These Additional Terms and Conditions do not apply to programmes provided by BPP University Limited and therefore do not apply to full-time ACCA courses and any examinations taken in conjunction with a full-time ACCA course.

Please read these Additional Terms and Conditions carefully before purchasing an Applicable Course which offers the BPP Pass Assurance Scheme. Please print off or keep a copy of these Additional Terms and Conditions for your records.

BPP will not file or otherwise keep a copy of the agreement concluded between you and BPP and a concluded agreement will not be available from BPP at a future time and date.

By ordering an Applicable Course to which the BPP Pass Assurance Scheme applies, you are confirming your agreement to be bound by these Additional Terms and Conditions.

If there is any conflict between these Additional Terms and Conditions, the Terms and Conditions and the Website Terms of Use, the conflict shall be resolved according to the following order of priority:

  1. the Additional Terms and Conditions
  2. the Terms and Conditions; and
  3. the Website Terms of Use.

Clauses 1 and 2 apply to all Applicable Courses under the BPP Pass Assurance Scheme. In addition, either Clause 3 or Clause 4 will apply depending on the relevant Applicable Course you purchase.

1. Definitions

1.1. Words and expressions defined in the General Terms and Conditions have the same meaning in these Additional Terms and Conditions except to the extent that they are varied by these Additional Terms and Conditions.
1.2. In these Additional Terms and Conditions, the following terms have the following meanings:

  • "Applicable Courses" means part-time Classroom Courses and Online Courses for the qualifications and papers set out in Clauses 3.2 and 4.2 of the Additional Terms and Conditions, provided by BPP in preparation for the Exams and Exams on Demand and which offer the BPP Pass Assurance Scheme;
  • "Awarding Body" means: (a) in relation to part-time ACCA, the Association of Chartered Certified Accountants; and (b) in relation to AAT, the Association of Accounting Technicians;
  • "BPP" means BPP Professional Education Limited;
  • "BPP Achievement Ladder" means a series of assessments structured as steps on a ladder that increase in scope and complexity.  The steps provide the structure to the programme and every step has a recommended due date;
  •  "BPP Pass Assurance Scheme" means the pass assurance scheme offered by BPP in relation to the Applicable Courses pursuant to these Additional Terms and Conditions;
  • "BPP Study Centre" means any study centre operated by BPP in the United Kingdom;
  • "CBA" means an Exam which is sat as a computer based assessment and includes computer based tests set by AAT;
  • "Course Tests" means the tests set by BPP during and in relation to an Applicable Course and includes course tests set by BPP for ACCA Applicable Courses and knowledge tests set by BPP for AAT Applicable Courses;
  • "Exam" means any examination paper relating to the Applicable Courses set out in Clause 4.2 (as applicable) and which are set by the relevant Awarding Body and sat at a BPP Study Centre or at an Awarding Body's centre;
  • "Exams on Demand" means a CBA relating to an AAT Applicable Courses set out in Clause 3.2 which can be sat at a participating BPP Study Centre on demand, rather than on specific dates set by the relevant Awarding Body;
  • "Excluded Items" means the items set out in Clauses 2.6,  2.7 and 2.8 which are excluded from the Free Exam on Demand or Free Course (as applicable) and which a Qualifying Student must purchase separately at your own cost, if required;
  • "Final Mock Exam" means the final online mock examination set by BPP in relation to the Applicable Course;
  • "Free Course" means a free enrolment on an Applicable Course that a Qualifying Student may take at a BPP Study Centre or online with BPP due to that Qualifying Student having previously participated in the same Applicable Course during the Offer Period, but having not passed the Exam relevant to that Applicable Course. The mode of study for the Free Course will be as set out in Clause 2.4.  The Free Course excludes the Excluded Items;
  • "Free Exam on Demand" means a free Exam on Demand that an AAT Qualifying Student may take at a BPP Study Centre due to that AAT Qualifying Student having previously sat during the Offer Period, but not having passed, the Exam relating to the AAT Applicable Course.  The Free Exam on Demand excludes the Excluded Items.  Free Exams on Demand are only available for AAT Qualifying Students;
  • "Offer Period" means the period from 1 January 2015 until the BPP Pass Assurance Scheme is withdrawn by BPP;
  • "Official Course Completion Date" means: (a) in relation to Applicable Courses that are taught as Classroom Courses or Online Classroom Live Courses, the date on which official tuition relating to that Classroom Course or Online Classroom Live Course is completed; (b) in relation to Applicable Courses that are taken as Online Classroom Courses, the date that is 7 days after the commencement of the final stage of that Online Classroom Course;
  • "Online Classroom Course" an Asynchronous Online Course which does not have a predetermined start date and is available for study by you immediately following delivery by BPP;
  • "Online Classroom Live Course" means a Synchronous Online Course which is only available for access by you on a predetermined start date;
  • "Qualifying Student" means any student who has purchased from BPP directly, and participates in an Applicable Course at any BPP Study Centre or online with BPP within the Offer Period and qualifies for the BPP Pass Assurance Scheme pursuant to these Additional Terms and Conditions; and
  • "Revision Course" means a revision course provided by BPP in relation to an Applicable Course and its relevant Exam and taught as a Classroom Course or an Online Classroom Live Course.

2. Additional Terms and Conditions for all Applicable Courses under the BPP Pass Assurance Scheme

2.1. In order to be a Qualifying Student under the BPP Pass Assurance Scheme, you must meet all of the following requirements in addition to any specific requirements relating to your relevant Applicable Course set out in Clauses 3 and 4 of these Additional Terms and Conditions:

  • 2.1.1. complete the relevant Applicable Course with BPP, either as a Classroom Course or an Online Course (as applicable); and
  • 2.1.2. for Classroom Courses and Online Classroom Live Courses, have a full 100% attendance record for the Applicable Course and Revision Course (if applicable) before attempting the relevant Exam; and
  • 2.1.3. have not passed the Exam in relation to your Applicable Course on your first attempt; and
  • 2.1.4. have paid your Course Fees in full by the date upon which those Course Fees were due to be paid under the General Terms and Condition for the Applicable Course; and
  • 2.1.5. notify BPP customer services at the time of booking your Free Exam on Demand or Free Course that you wish to use the BPP Pass Assurance Scheme; and
  • 2.1.6. have purchased your Applicable Course from BPP directly and not from a third party

2.2. The BPP Pass Assurance Scheme shall not apply where the requirements of Clause 2.1, and clauses 3 or 4 (as applicable) above have not been met in full.
2.3. The BPP Pass Assurance Scheme and places on Free Exams on Demand and Free Courses are subject to availability.  You may be offered an alternate venue if your first choice of BPP Study Centre is unavailable on the date requested for a Free Exam on Demand or Free Course. You may be offered an alternate Free Course where your first choice of Free Course is unavailable on the date requested. If you decline any such an offer, BPP shall be under no obligation to provide any Free Course to you under the BPP Pass Assurance Scheme.
2.4 The mode of study available to you for your Free Course will depend on the mode of study which you purchased for your original Applicable Course:

  • 2.4.1 Qualifying Students who have purchased and participated in an ACCA Applicable Course as a Classroom Course or Online Classroom Live Course, will be entitled to book and enrol on a Free Course as either a Classroom Course, an Online Classroom Live Course or as an Online Classroom Course;
  • 2.4.2 Qualifying Students who have purchased and participated in an ACCA Applicable Course as an Online Classroom Course will be entitled to book and enrol on a Free Course only as an Online Classroom Course (excluding Online Classroom Live Courses);
  • 2.4.3 Qualifying Students who have purchased and participated in an AAT Applicable Course as a Classroom Course, an Online Classroom Live Course or an Online Classroom Course will be entitled to book and enrol on a Free Course only as an Online Classroom Course (excluding Online Classroom Live Courses).

2.5. Only one Free Course (where applicable) will be offered to each Qualifying Student in respect of each Applicable Course purchased. If any Qualifying Student does not pass the relevant Exam following a Free Course, BPP shall not be obliged to offer that Qualifying Student any further Free Course(s). This Clause does not prevent a Qualifying Student from booking and enrolling on any further Classroom Course or Online Course at their own cost.
2.6. Where Free Exams on Demand and/or Free Courses are provided to Qualifying Students in accordance with the BPP Pass Assurance Scheme under these Additional Terms and Conditions, the relevant Free Exam on Demand or Free Course shall not include any Study Materials unless you are notified otherwise at the time of booking. You will be responsible for ensuring that you acquire, at your own cost, any additional Study Materials which you require for the relevant Free Exam on Demand or Free Course.
2.7. BPP shall only be obliged to provide Free Exams on Demand and Free Courses (as applicable) to Qualifying Students pursuant to these Additional Terms and Conditions. For the avoidance of doubt, unless specifically stated, the BPP Pass Assurance Scheme does not include any additional tuition or revision courses that do not form part of the Free Exams on Demand or Free Courses (as applicable).
2.8. The BPP Pass Assurance Scheme does not include any other discount or financial benefit to Qualifying Students and excludes any amounts payable to Awarding Bodies or any other professional body for membership.
2.9. BPP may withdraw the BPP Pass Assurance Scheme at any time in its sole discretion. Any such withdrawal shall not affect students who have purchased and are participating in an Applicable Courses at the date of such withdrawal. Such students shall continue to be eligible for the BPP Pass Assurance Scheme in relation to the Applicable Course which they are undertaking.
2.10. Qualifying Students may not transfer or assign the Free Exam(s) on Demand and/or Free Course(s) (as applicable) for which they are eligible under the BPP Pass Assurance Scheme to any other person.
2.11. In no circumstances shall BPP either: (i) refund your Course Fees nor (ii) provide a cash alternative to the BPP Pass Assurance Scheme, in the event that any Free Exams on Demand or Free Courses are unavailable pursuant to clause 2.3.
2.12. If you have breached, or, are in breach of any of the Terms and Conditions you will not be eligible for the BPP Pass Assurance Scheme.
2.13. BPP may update or amend these Additional Terms and Conditions from time to time to comply with law or to meet its changing business requirements without notice to you. Any updates or amendments will be posted on the Website.
2.14. These Additional Terms and Conditions and any other matters arising out of or in relation to these Additional Terms and Conditions, shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the English courts to settle any dispute which may arise out of or in connection with these terms and conditions.

3. Additional Terms and Conditions for AAT

3.1. Subject to the provisions of Clause 2 and this Clause 3, if you are a Qualifying Student who has purchased and participated in one of the Applicable Courses set out in Clause 3.2 below during the Offer Period, and you do not pass the Exam on Demand in relation to your Applicable Course on your first attempt, you will be permitted to book and sit a maximum of two Free Exams on Demand and/or book and enrol on one Free Course relating to the same Exam on Demand, free of charge at a BPP Study Centre.  Any further Exams on Demand or courses required shall be at your own expense.
3.2. For the purposes of this Clause 3, Applicable Courses relate to each of the following Exams to which the BPP Pass Assurance Scheme applies:

  • 3.2.1. AAT: PBKT,CJBS, BCST, CPAG, WKAF, ACPR, PETH, ITAX, CSTR, FSTP, SDST, BDGT, FPFM, FSTM, ISYS, BTAX, PTAX, CSHM, EXTA.

3.3. In addition to the requirements set out in Clause 2.1 and Clause 3.2 above, you must:

  • 3.3.1 record scores of 80% or more on every Course Test and in the Final Mock Exam (the Course Tests and Final Mock Exam may be taken multiple times during the term of the Course until a you reach your desired score, but may not be taken after the Official Course Completion Date); and
  • 3.3.2. book and sit your first attempt at the Exam on Demand for your Applicable Course at a BPP Study Centre within three (3) weeks of the Official Course Completion Date); and
  • 3.3.3. sit all Free Exam(s) on Demand for your Applicable Course at a BPP Study Centre within eight (8) weeks of the Official Course Completion Date; and
  • 3.3.3 book and commence your Free Course within 3 months of you having taken and not passed your first attempt at the Exam on Demand for your Applicable Course.

4. Additional Terms and Conditions for part-time ACCA (excluding Knowledge F1 to F3 and Skills F4)

4.1. Subject to the provisions of Clause 2 and this Clause 4 if you are a Qualifying Student who has purchased and participated in one of the Applicable Courses set out in Clause 4.2 below during the Offer Period, and you do not pass the Exam in relation to your Applicable Course on your first attempt, you will be permitted to book and enrol on one a Free Course relating to the same Exam.
4.2. For the purposes of this Clause 4, Applicable Courses relate to each of the following Exams to which the BPP Pass Assurance Scheme applies:

  • 4.2.1. ACCA Skills: F5, F6, F7, F8 and F9;
  • 4.2.2. ACCA Essentials: P1, P2 and P3;
  • 4.2.3. ACCA Options: P4, P5, P6 and P7.

4.3 The BPP Pass Assurance Scheme will only apply to the Applicable Courses set out in Clause 4.2 above when you purchase one taught course and one revision course together as a Classroom Course or an Online Classroom Live Course, or an integrated Online Classroom Course, in relation to one ACCA Exam.  For Classroom Courses and Online Classroom Live Courses, the Applicable Course and Revision Course do not need to be taken in the same mode for the BPP Pass Assurance Scheme to apply.
4.4. In addition to the requirements set out in Clause 2 and Clauses 4.2 and 4.3 above, you must:

  • 4.4.1. complete and submit step 1 of the BPP Achievement Ladder relevant to the Applicable Course, by the relevant submission date  specified in the course information provided by BPP about your Applicable Course, and achieve a minimum score of 75% on step 1 (multiple attempts permitted); and
  • 4.4.2. complete and submit steps 4 and 6 of the BPP Achievement Ladder relevant to the Applicable Course, by the relevant submission dates  specified in the course information provided by BPP about your Applicable Course, and achieve a minimum score of 30% on each step; and
  • 4.4.3. book and commence your Free Course at the next sitting after having taken and not passed the Exam in relation to your Applicable Course.
